Our SMS Program consists of regular text (SMS) messages sent to your mobile device to keep you apprised of our latest events, services, coupons, deals, or other of our offerings or the offerings of our affiliates, as the case may be.
If you opt-in to our SMS Program, you can expect to receive messages of the nature described above in accordance with these SMS Terms.
We will not send you any messages through our SMS Program (other than the Opt-In Message, described below) unless you “opt-in” to the SMS Program and give your affirmative consent to receive text messages from us.
If you provide us with your mobile phone number, we will send you a message substantially similar in form and substance to the following (the “Opt-In Message”):
You may opt-in to the SMS Program by responding “Yes” to the Opt-In Message.
You can cancel or opt-out of your participation in the SMS Program at any time. To do so, just text “STOP” to the number from which you are receiving messages. After you send the SMS message “STOP” to us, we will send you a final SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.
You will receive no more than 60 messages per month. If you receive more than 60 messages per month, please contact us as set forth in the section entitled “Contact Us” below so we can remedy this issue.

Our SMS Program should be available through your mobile device when the device is within the operating range of your wireless service provider. Our SMS Program may not be available on all mobile devices, or through all wireless carriers. We may, from time to time, in our discretion and without notice to you, limit the carriers that support our SMS Program.
Delivery of information and content to your mobile device may fail due to a variety of circumstances or conditions. Our SMS Program is subject to transmission limitations or interruptions. You understand and acknowledge that mobile network services are outside of our control, and that we are not responsible or liable for issues arising therefrom, or the failure thereof, including, without limitation, technical, hardware, software, electronic, network, telephone or other communications malfunctions, errors or failures of any kind, errors in transmission, traffic congestion, lost or unavailable network connections, telephone connections, wireless phone connections, website, internet or ISP availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of entry information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed transmissions which may limit or restrict your ability to receive or send a message, including any injury or damage to your or any other person’s equipment/wireless device relating to or resulting from participating in or using our SMS Program.
Carriers are not liable for delayed or undelivered messages. As always, message and data rates may apply for any messages sent to you from us and to us from you. As set forth above, you will receive no more than 60 messages per month. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
Your Mobile Telephone Number
By opting in to use of our SMS Program, you represent that you are the account holder for the mobile telephone number(s) that you provide or that you have the account holder’s permission to enter the mobile telephone number(s) that you provide and that you will not initiate messages to the mobile phone of any other person or entity. You agree to maintain accurate, complete, and up-to-date information with us regarding your participation in our SMS Program, including, without limitation, notifying us immediately if you change, or cease to be the regular user of, your mobile telephone number. You agree to indemnify us in full for all claims, expenses, damages, and costs, including reasonable attorneys’ fees, related to or caused in whole or in part by your failure to notify us if you change your telephone number, or cease to be the regular user of your telephone number, including, without limitation, all claims, expenses, damages, and costs related to or arising out of the Telephone Consumer Protection Act § 227 et seq
