Skipper Pets, Inc., a Delaware corporation, as well as its affiliates and subsidiaries (collectively, “we” or “us” or “our”) respects the privacy of our users (“user” or “you”). This policy (this “Privacy Policy”) explains how we collect, use, disclose, and safeguard your information when you are on site at any location where we provide our services (our “Facilities”) or when you utilize any of our websites (walkskipper.com, skipperpets.com, skiptown.io, collectively the “Websites”), our mobile application  (Skiptown, available on Apple App Store and Google Play, the “Mobile App”), or our other media forms, media channels, mobile websites, any additional associated sites, or mobile applications related or connected thereto (along with our Websites and our Mobile App, collectively, our “Digital Properties”). Please read this Privacy Policy, as well as our related Terms of Use, carefully.  If you do not agree with the terms of this Privacy Policy or our Terms of Use, please do not access our Facilities or any of our Digital Properties.

CHANGES TO OUR PRIVACY POLICY

We reserve the right to make changes to this Privacy Policy at any time and for any reason.  The date this Privacy Policy was last revised is identified at the top of the page (the “Last Updated Date”). We will alert you about any changes by updating the Last Updated Date of this Privacy Policy.  Any changes or modifications will be effective immediately upon posting the updated Privacy Policy on our Digital Properties, and you waive the right to receive specific notice of each such change or modification.

You are encouraged to periodically review this Privacy Policy to stay informed of updates. You will be deemed to have been made aware of, will be subject to, and will be deemed to have accepted the changes in any revised Privacy Policy by your continued use of Digital Properties after the date such revised Privacy Policy is posted.

Children under the Age of 18

Our Facilities and Digital Properties are not intended for Children under 18 years of age. No one under age 18 may provide any personal information to or on our Digital Properties. We do not knowingly collect personal information from children under 18. If you are under 18, do not access our Facilities, use or provide any information on our Digital Properties or through any of their features, register on our Digital Properties, make any purchases through our Digital Properties, use any of the interactive or public comment features of our Digital Properties, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received personal information from a child under 18 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 18, please contact us using the information provided in the “Contact Us” section below.

California residents under 16 years of age may have additional rights regarding the collection and sale of their personal information. Please see Your State Privacy Rights for more information.

The Children Online Privacy Protection Act (COPPA) puts parents in control of their children’s personal information. The Federal Trade Commission, United States’ consumer protection agency, enforces COPPA, which spells out what operators of websites and online services must do to protect children’s privacy and safety online. We do not specifically market to children under the age of 13 years old and by agreeing to this Privacy Policy, you attest you are of legal age to enter into a legally binding contract (minimum of 18 years old).

COLLECTION OF YOUR INFORMATION

We may collect information about you in a variety of ways. You are under no obligation to provide us with information of any kind; however, by accessing our Facilities or using any of our current or future Digital Properties, you automatically agree and are subject to private data collection. We may use the information we collect on our Digital Properties or at our Facilities for any purpose set forth in the section on How We Use Your Information below. The data we may collect on our Digital Properties includes, but is not limited to, the following:

PERSONAL DATA

We may collect personally identifiable information, such as your name, home address, email address, and telephone number, and demographic information, such as your age, gender, hometown, and interests, that you voluntarily give to us when you register with our Digital Properties or when you choose to participate in various activities related to our Digital Properties or Facilities, including but not limited to memberships, compatibility days, email messaging, etc.

Video Recordings and Images

While you, your family, or your pet are physically on location at one of our Facilities or at any other location where we provide services from time to time, we may take photographs or create video or audio recordings of you, your family, or your pet and retain each of the foregoing.

DERIVATIVE DATA

We may collect information our servers collect when you access our Digital Properties, such as but not limited to your IP address, your browser type, your operating system, your access times, and the pages you have viewed directly before and after accessing Digital Properties. If you are using our mobile application, this information may also include your device name and type, your operating system, your phone number, your country, your replies and correspondence through our Digital Properties, and other interactions with the application and other users via server log files, as well as any other information you provide in the use of our Digital Properties.

FINANCIAL DATA

We may collect financial information, such as data related to your payment method (e.g. valid credit card number, card brand, expiration date, CV #) that we may collect when you purchase, order, return, exchange, or request information about our services from our Digital Properties. Your financial information is also stored by our payment processor and you are encouraged to review their privacy policy and contact them directly for responses to your questions. All transactions are processed through a gateway provider and are not stored or processed on our servers. MOBILE DEVICE DATA

We may collect device information, such as your mobile device ID, model, and manufacturer, and information about the location of your device, if you access our Digital Properties from a mobile device.

THIRD-PARTY DATA

We may collect information from third parties, such as personal information or network friends, if you connect your account to a third party and grant Digital Properties permission to access this information.

Occasionally, at our discretion, we may include or offer third-party products or services on our website. These third-party sites have separate and independent privacy policies. We therefore have no responsibility or liability for the content and activities of these linked sites.

DATA FROM CONTESTS, GIVEAWAYS, AND SURVEYS

We may collect personal and other information you may provide when entering contests or giveaways and/or responding to surveys.

GOOGLE

Google’s advertising requirements can be summed up by Google’s Advertising Principles. They are put in place to provide a positive experience for the user. We reserve the right to have Google AdSense or other similar technology enabled on our Digital Properties at our discretion and without notice.

MOBILE APPLICATION INFORMATION

If you connect using our mobile application:

Geo-Location Information. We may request access or permission to and track location-based information from your mobile device, either continuously or while you are using our mobile application, to provide location-based services. If you wish to change our access or permissions, you may do so in your device’s settings.

Mobile Device Access. We may request access or permission to certain features from your mobile device, including your mobile device’s Bluetooth, calendar, camera, contacts, microphone, reminders, sensors, SMS messages, social media accounts, storage, and other features. If you wish to change our access or permissions, you may do so in your device’s settings.

Mobile Device Data. We may collect device information (such as your mobile device ID, model and manufacturer), operating system, version information and IP address.

Push Notifications. We may request to send you push notifications regarding your account or the Application. If you wish to opt-out from receiving these types of communications, you may turn them off in your device’s settings.

SMS MESSAGING

If you “opt-in” to participate in our SMS text messaging program (our “SMS Program”), pursuant to which we provide our users with regular text message updates regarding our latest events, services, coupons, deals, or other of our offerings or the offerings of our affiliates, we may collect and retain any information that you provide in text messages you send to us through our SMS Program.

USE OF YOUR INFORMATION

Having accurate information about you permits us to provide you with a smooth, efficient, and customized experience.  We may use information collected about you via our Digital Properties or at our Facilities to, among other things:

  • Administer sweepstakes, promotions, and contests.
  • Assist law enforcement and respond to subpoena.
  • Compile statistical data and analysis for use internally or with third parties.
  • Create and manage your account.
  • Deliver targeted advertising, coupons, newsletters, and other information regarding promotions and our Digital Properties to you.
  • Email you regarding your account or order.
  • Enable user-to-user communications.
  • Fulfill and manage purchases, orders, payments, and other transactions related to our Digital Properties
  • Generate a personal profile about you to make future visits to Digital Properties more personalized.

  • Request feedback and contact you about your use of our Digital Properties.
  • Resolve disputes and troubleshoot problems.
  • Respond to product and customer service requests.
  • Send you a newsletter.
  • Solicit support for our Digital Properties.

DISCLOSURE OF YOUR INFORMATION

We may share information we have collected about you in certain situations. Your information may be disclosed as follows: 

BY LAW OR TO PROTECT LEGAL RIGHTS

If we believe the release of information about you is necessary to respond to legal process, to investigate or remedy potential violations of our policies, or to protect the rights, property, and safety of others, we may share your information as permitted or required by any applicable law, rule, or regulation.  This includes exchanging information with other entities for fraud protection and credit risk reduction. Additionally, if you, your family, or your pet violate our Terms of Use by harming another user, their pet, or their property, we may provide your contact information and any information we have evidencing the violation to such user upon request or otherwise in our discretion.

THIRD-PARTY SERVICE PROVIDERS

We may share your information with third parties that perform services for us, on our behalf, or at our Facilities, including, without limitation, payment processing, data analysis, email delivery, hosting services, customer service, marketing assistance, veterinary services, or other pet care services. MARKETING COMMUNICATIONS

With your consent, or with an opportunity for you to withdraw consent, we may share your information with third parties for marketing purposes, as permitted by law. INTERACTIONS WITH OTHER USERS

If you interact with other users of our Digital Properties, those users may see your name, profile photo, and descriptions of your activity, including sending invitations to other users, chatting with other users, liking posts, following blogs.

ONLINE POSTINGS

When you post comments, contributions or other content to our Digital Properties, your posts may be viewed by all users and may be publicly distributed outside our Digital Properties in perpetuity.

THIRD-PARTY ADVERTISERS

We may use third-party advertising companies to serve ads when you visit our Digital Properties. These companies may use information about your visits to our Digital Properties and other websites that are contained in web cookies in order to provide advertisements about goods and services of interest to you.

AFFILIATES

We may share your information with our affiliates, in which case we will require those affiliates to honor this Privacy Policy. Affiliates include our parent company and any subsidiaries, joint venture partners or other companies that we control or that are under common control with us.

BUSINESS PARTNERS

We may share your information with our business partners to offer you certain products, services or promotions.

OFFER WALL

Our mobile application may display a third-party hosted “offer wall.”  Such an offer wall allows third-party advertisers to offer virtual currency, gifts, or other items to users in return for acceptance and completion of an advertisement offer.  Such an offer wall may appear in our mobile application and be displayed to you based on certain data, such as your geographic area or demographic information. When you click on an offer wall, you will leave our mobile application.  A unique identifier, such as your user ID, will be shared with the offer wall provider in order to prevent fraud and properly credit your account.

SOCIAL MEDIA CONTACTS 

If you connect to our Digital Properties through a social network, your contacts on the social network will see your name, profile photo, and descriptions of your activity.

OTHER THIRD PARTIES

We may share your information with advertisers and investors for the purpose of conducting general business analysis. We may also share your information with such third parties for marketing purposes, as permitted by law. However, data obtained through our SMS Program will not be shared to third parties for their marketing purposes. For more information regarding our SMS Program, please see our SMS Terms of Service.

SALE OR BANKRUPTCY

If we reorganize or sell all or a portion of our assets, undergo a merger, or are acquired by another entity, we may transfer your information to the successor entity.  If we go out of business or enter bankruptcy, your information would be an asset transferred or acquired by a third party. You acknowledge that such transfers may occur and that the transferee may decline to honor commitments we made in this Privacy Policy.

We are not responsible for the actions of third parties with whom you share personal or sensitive data, and we have no authority to manage or control third-party solicitations.  If you no longer wish to receive correspondence, emails or other communications from third parties, you are responsible for contacting the third party directly.

TRACKING TECHNOLOGIES

COOKIES AND WEB BEACONS

We may use cookies, and other tracking technologies on our Digital Properties, to help customize our Digital Properties and improve your experience. When you access our Digital Properties, your personal information is not collected through the use of tracking technology. Most browsers are set to accept cookies by default. You can remove or reject cookies but be aware that such action could affect the availability and functionality of Digital Properties. You may not decline web beacons. However, they can be rendered ineffective by declining all cookies or by modifying your web browser’s settings to notify you each time a cookie is tendered, permitting you to accept or decline cookies on an individual basis.

We use cookies for tracking purposes. Whenever you interact with our Services, we automatically receive and record information on our server logs from your browser or device, which may include your IP address, geolocation data, device identification, “cookie” information, the type of browser and/or device you’re using to access our Services, and the page or feature you requested. “Cookies” are identifiers we transfer to your browser or device that allow us to recognize your browser or device and tell us how and when pages and features in our Services are visited and by how many people. You may be able to change the preferences on your browser or device to prevent or limit your device’s acceptance of cookies, but this may prevent you from taking advantage of some of our features. INTERNET-BASED ADVERTISING

Additionally, we may use third-party software to serve ads on our Digital Properties, implement email marketing campaigns, and manage other interactive marketing initiatives.  This third-party software may use cookies or similar tracking technology to help manage and optimize your online experience with us. WEBSITE ANALYTICS

We may also partner with selected third-party vendors to allow tracking technologies and remarketing services on our Digital Properties through the use of first party cookies and third-party cookies, to, among other things, analyze and track users’ use of our Digital Properties, determine the popularity of certain content and better understand online activity. By accessing our Digital Properties, you consent to the collection and use of your information by these third-party vendors. You are encouraged to review their privacy policy and contact them directly for responses to your questions. We do not transfer personal information to these third-party vendors. You should be aware that getting a new computer, installing a new browser, upgrading an existing browser, or erasing or otherwise altering your browser’s cookies files may also clear certain opt-out cookies, plug-ins, or settings.

CHOICES ABOUT HOW WE USE AND DISCLOSE YOUR INFORMATION

We strive to provide you with choices regarding the personal information you provide us. We have created mechanisms to provide you with the following control over your information:

  • Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. You can choose whether or not to allow the Digital Properties to collect information through other tracking technologies through the settings feature on your mobile device. We honor “Do Not Track Signals” (“DNT”) and do not track, plant cookies, or use advertising when a DNT browser mechanism is in place. If you disable or refuse cookies or block the use of other tracking technologies through a DNT browser mechanism, some parts of the Digital Properties may then be inaccessible or not function properly.
  • Location Information. You can choose whether or not to allow the Digital Properties to collect and use real-time information about your mobile device’s location through your devices privacy settings. If you block the use of location information, some parts of the Digital Properties may become inaccessible or not function properly.
  • Disclosure of Your Information for Third-Party Advertising. If you do not want us to share your personal information with unaffiliated or non-agent third parties for promotional purposes, you can opt-out by logging into the Digital Properties and adjusting your user preferences in your account profile or by contacting us using the information provided in the “Contact Us” section below. Additionally, data obtained through our SMS Program will not be shared to third parties for their marketing purposes.   • Promotional Offers from Us. If you do not want us to use your email address or phone number to promote our own or third parties’ products or services, you can opt-out by unsubscribing from our emails using the link at the bottom of each email we send. You can also always opt-out by logging into the Digital Properties and adjusting your user preferences in your account or by contacting us using the information provided in the “Contact Us” section below and opting-out from further messages to your email address or phone number.
  • Targeted Advertising. If you do not want us to use information that we collect or that you provide to us to deliver advertisements according to our advertisers’ target-audience preferences, you can opt-out by logging into the Digital Properties and adjusting your user preferences in your account profile or by contacting us using the information provided in the “Contact Us” section below.

We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative. Accessing and Correcting Your Personal Information

You may at any time review or request to change the information in your account by:

  • Logging into your account settings and updating your account;
  • Logging into your user profile and editing your information; or
  • Cancelling or deleting your account through your user profile (User Details) or by contacting us using the information provided in the “Contact Us” section below.

Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, some information may be retained in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our Terms of Use and/or comply with legal requirements.

If you delete your contributions to our Digital Properties, copies of your contributions may remain viewable in cached and archived pages or might have been copied or stored by other users of our Digital Properties. Proper access and use of information provided on the Digital Properties, including user contributions, is governed by our Terms of Use.

THIRD-PARTY WEBSITES

Digital Properties may contain links to third-party websites and applications of interest, including advertisements and external services, that are not affiliated with us. Once you have used these links to leave Digital Properties, any information you provide to these third parties is not covered by this Privacy Policy, and we cannot guarantee the safety and privacy of your information. Before visiting and providing any information to any third-party websites, you should inform yourself of the privacy policies and practices (if any) of the third party responsible for that website, and should take those steps necessary to, in your discretion, protect the privacy of your information. We are not responsible for the content or privacy and security practices and policies of any third parties, including other sites, services or applications that may be linked to or from Digital Properties.

SECURITY OF YOUR INFORMATION

Our website is scanned on a regular basis for security holes and known vulnerabilities in order to make your visit to our site as safe as possible. We use regular Malware Scanning. Your personal information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems and are required to keep the information confidential. In addition, all sensitive/credit information you supply is encrypted via Secure Socket Layer (SSL) technology. We implement a variety of security measures when a user enters, submits, or accesses their information to maintain the safety of your personal information. All transactions are processed through a gateway provider and are not stored or processed on our servers.

We use administrative, technical, and physical security measures to help protect your personal information.  While we have taken reasonable steps to secure the personal information you provide to us, please be aware that despite our efforts, no security measures are perfect or impenetrable, and no method of data transmission can be guaranteed against any interception or other type of misuse.  Any information disclosed online is vulnerable to interception and misuse by unauthorized parties. Therefore, we cannot guarantee complete security if you provide personal information. We strongly recommend you use a strong password with numbers, letters (lowercase and uppercase) and symbols and not to share this password with anyone.

CAN SPAM ACT

The CAN-SPAM Act is a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have emails stopped from being sent to them, and spells out tough penalties for violations.

We collect your email address in order to:

  • Send information, respond to inquiries, and/or other requests or questions.
  • Process orders and to send information and updates pertaining to orders.
  • Send you additional information related to your product and/or service.
  • Market to our mailing list or continue to send emails to our clients after the original transaction has occurred.

To be in accordance with CANSPAM, we agree to the following:

  • Not use false or misleading subjects or email addresses.
  • Identify the message as an advertisement in some reasonable way.
  • Include the physical address of our business or site headquarters.
  • Monitor third-party email marketing services for compliance, if one is used.

State consumer privacy laws may provide their residents with additional rights regarding our use of their personal information. California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please contact us to submit your request in writing using the contact information provided in the “Contact Us” section below.

If you are under 18 years of age, reside in California, and have a registered account with Digital Properties, you have the right to request removal of unwanted data that you publicly post on Digital Properties. To request removal of such data, please contact us using the contact information provided in the “Contact Us” section below and include the email address associated with your account and a statement that you reside in California.  We will make sure the data is not publicly displayed on Digital Properties, but please be aware that the data may not be completely or comprehensively removed from our systems.

Colorado, Connecticut, Virginia, and Utah each provide their state residents with rights to:

  • Confirm whether we process their personal information.
  • Access and delete certain personal information.
  • Data portability.
  • Opt-out of personal data processing for targeted advertising and sales.

Colorado, Connecticut, and Virginia also provide their state residents with rights to:

  • Correct inaccuracies in their personal information, taking into account the information’s nature processing purpose.
  • Opt-out of profiling in furtherance of decisions that produce legal or similarly significant effects.
